In the face of increasing signs related to trade remedies evasion and origin fraud, etc., Decree No. 111/2021/ND-CP was published by the Government of Vietnam, which is considered as one of the most effective solutions currently.
On 09th December 2021, the Government of Vietnam issued Decree No.111/2021/ND-CP which has amended, supplemented some regulations of Decree No. / 43/2017/ND-CP released on 14th April 2017 by the Government. The revision relates to the goods label, and below are the most important points of the new Decree No.111.
The label of goods that have been circulating in Vietnam’s market must present the following contents in Vietnamese: (i) name of goods; (ii) name and address of the organizations/ individuals who are responsible for the goods; (iii) the origin of goods; (iv) several mandatory contents depending on the essence of each type of goods as prescribed in Appendix I of this Decree. For instance, for commodities group of food, the compulsory contents which must be shown on their labels are quantity, production date, expiry date, and warning information if any.
Importantly, cargoes imported into Vietnam are required to present the following contents in foreign languages or Vietnamese when doing customs clearance procedures: (i) name of goods; (ii) the origin of goods; (iii) the name or abbreviation of the organization/individual who produces or takes responsibility for such goods in a foreign country.
The government of Vietnam issued Decree No. 111/2021/ND-CP to reduce trade remedies evasion and origin fraud, etc.
The origin of goods in the label is self-determined by the organization/ individual who manufactures, export, or imports the goods with truthfulness, accuracy, and compliance with the law on the origin of exports, imports, and domestically manufactured goods or treaties to which Vietnam has acceded. In case the origin of goods cannot be identified under the above regulations, the label must show the place where the final stage to finish goods is completed. The place of completing the final stage to finish goods shall be presented with one of the following phrases or combined phrases showing the stage of finishing goods “assembled in”, “bottled in”, “mixed in”, “finished in”, “packed in” or “labeled in” followed by the name of the country or territory where the final stage to finish goods is completed.
In addition, labels of goods being health equipment produced in the country or imported for circulation in Vietnam must present the name and address of the health equipment owner or the name and address of the owner of the health equipment circulation registration number. In case the health equipment does not have a circulation registration number, the import permit is required to show the name and address of the health equipment owner and the name and address of the organization or person.
Decree No. 111/2021/ ND-CP takes effect on February 15, 2022.
